Biographical

My legal career started in 1973 and covered virtually all aspects of what is commonly referred to as a commercial practice until I went Non-Ptractising.. I have appeared in all levels of Courts in the Province of Nova Scotia and numerous administrative bodies. Beginning in 1995 my practice shifted to acting as a neutral independent full time commercial and labour arbitrator and mediator with many thousands of hours in these roles. Although most of my retainers come from consensual appointments by lawyers in all the Atlantic Provinces, I have also served on the rosters as both mediator and arbitration for many provincial and federal boards and tribunals.

My education includes a Bachelor of Commerce from Dalhousie University, a law degree from Dalhousie University Schulich School of Law, Certificate in Environmental Management from DalTech, Certificate in Negotiation and Conflict Management from Dalhousie University Schulich School of Law and Henson College, advanced mediation courses endorsed by the ADR Atlantic Institute as well as with the International Academy of Mediators in Toronto, Los Angeles (Pepperdine University), Atlanta, New York, Boston (Harvard), Salt Lake City, Austin, the SDRCC in Montreal, Quebec City and Winnipeg and the American Bar Association, Dispute Resolution Section, in Atlanta, New York and Miami. I have completed the ADRIO course "Practical Ethics for Working Mediators and the SDRCC course on sexual harassment.

I consider a few of my personal highlights being awarded a Queens Council, an AV rating by Martindale-Hubbell, recognized by Canadian Legal LEXPERT Directory as a leading practitioner in Nova Scotia in Property Leasing and Property Development, President of the Canadian Bar Association (Nova Scotia Division), awarded the Chartered Arbitrator and Chartered Mediator designations by the ADR Institute of Canada and designated a Distinguished Fellow of the International Academy of  Mediators.

I have been a guest lecturer for numerous educational institutions, Bar Admission Courses, the Atlantic Trial Lawyers Association, the Canadian Defence Lawyers, Insight and various Continuing Legal Education Seminars for various professional bodies including the Canadian Bar Association, Nova Scotia Barristers Society and ADR Institute of Canada Inc. I was a member of the Part Time Faculty at the Dalhousie University Schulich School of Law lecturing in Dispute Resolution.

Rates Information

All Services are provided on-line using Zoom.

On-Line Expedited Facilitation of no more than three hours including an on-line pre expedited facilitation meeting respecting the process and procedures for receiving in digital form briefs less than 10 pages. This service is for parties close to an arrangement and conducted primarily in a joint session with breakout rooms available for private client consultations, with minimal involvement of the facilitator. The facilitation is held usually within a few weeks of booking. The cost is $750 per party with no cancellation fees.  Additional services convert this process to an On-Line Standard Mediation with an applicable fee rate as noted below.

On-Line Standard Mediation with up to an 8-hour mediation together with pre mediation on-line meetings respecting the mediation process and the procedures for receiving in digital form the mediation briefs, exhibits and case authorities and any follow ups as needed. The cost is $1,500 per party with no cancellation fees. Additional standard mediation services at $150 per hour per party. 

On-Line Labour Arbitration with up to an 8-hour hearing together with pre arbitration on-line meetings respecting the hearing process and the  procedures for receiving in digital form the grievance and hearing briefs, exhibits and case authorities together with preparing a written decision which depending on the evidence, facts, and issues the fee is usually in the range of $1,500 to $2,500 per party.  Additional arbitration services, including for extended hearings, at $150 per hour per party.  Cancellation fees are time charges incurred plus $500 per party if cancelled within two weeks of the scheduled hearing date.

On-Line Commercial Arbitration with up to an 8 hour hearing together with pre arbitration on-line meetings respecting the hearing process and the procedures for receiving in digital form the claim and response, pre and post hearing briefs, exhibits and case authorities together with preparing a written decision. Depending on the evidence, facts, and issues the fee is usually in the range of $2,000 to $3,000 per party. Additional services including for extended hearings at $150 per hour divided between the parties. Cancellation fees are time charges incurred plus $500 per party if cancelled within two weeks of the scheduled hearing date.

On-Line Contract Facilitation to manage an extended on-line process necessary for the participants to negotiate labour or commercial contracts. As may be requested by the parties, breakout rooms, private meeting rooms and joint session rooms are available. The initial cost is $750 per party for three hours. Additional facilitation only services at $125 per hour per party. There are no cancellation fees. This service is intended for parties who have long protracted negotiations, including both short and long sessions which may continue over days or weeks and require a virtual service managed by a trusted neutral familiar with the dynamics of negotiations.

HST of 15% is added to all fees. There are no disbursements.
