Biographical

In my private mediation practice, I help people mediate in 4 main areas: Personal Injury/Insurance, Estates, Employment, and Civil/Commercial Matters:

First, I help people mediate Personal Injury/Insurance matters including motor vehicle accidents (AB/Tort/Global) based in large part on my 16+ years with the Financial Services Commission of Ontario (FSCO) as a mediator and settlement officer for the Ontario Government mediating over 7400 accident benefits mediations and settlement conferences, and during part of that time also conducting motor vehicle mediations with Manitoba Public Insurance Corporation at the Automobile Mediation Office (AIM) in Winnipeg. I also help people with mediation in the areas of disability claims, life insurance claims, slip and falls, and fire/property losses.

Secondly, through my experience gained in my wills and estate law practice in Ontario and Manitoba for over 30 years prior to FSCO, I helped clients to resolve many estate disputes through direct negotiation and facilitation with opposing counsel and the other parties "around the table".

And finally, through my 30+ years' experience as a lawyer advising clients in the area of business law dealing with independent business, commercial matters, real estate, and landlord/tenant matters, insurance, and employment issues, I also help people mediate disputes in these areas, in both my private practice and as a Roster Mediator with the Ontario Mandatory Mediation Office (OMMP), Toronto and Ottawa, since 1999.

PROFESSIONAL HISTORY

Member, Discipline and Appeal Committees of the Real Estate Council of Ontario ("RECO") December, 2016 to present; Executive Committee member ADR Section OBA 2017 to present; Member ODR Task Force ADR Institute of Canada, September 2018 to 2020; Part time lawyer member Ontario (Mental Health) Consent & Capacity Board, appointed by Ontario Cabinet for a 3 year term February 10, 2006; Trainer, Dispute Resolution Group, (DRG), Financial Services Commission of Ontario; ("FSCO"), 2003 and 2004 Settlement Officer, DRG, FSCO, July, 2002 to 2016; Mediator, DRG, FSCO, February 14, 2000 to 2016 having completed over 7400 mediations and settlement conferences;

He also served as ADRIO’s member on the York University Dispute Resolution Advisory Committee (“DRAC”) for a 3 year period.  He has coached Osgoode Hall Law School students in mediations held in Ontario’s Small Claims Court, and has participated in a program for York University Dispute Resolution Student Observers at FSCO, 2009 and 2010.

Mr. Arkin was formerly associated with Rye & Partners in Toronto, and the Winnipeg law firms of Duboff, Edwards, Haight & Schachter; Oliver, Derksen, Arkin; Thompson, Dorfman, Sweatman; and Aikins, MacAulay & Thorvaldson. He is a Chartered Mediator (C. Med. 2002) with the ADR Institute of Canada, an International Mediation Institute (IMI) Certified Mediator and Reviewer (2009).  From 2000 to May 2006, he was a member of the Board of Directors, ADR Institute of Ontario (“ADRIO”), and served as its Vice President of Education for a one year period during that time.

He also served as ADRIO’s member on the York University Dispute Resolution Advisory Committee (“DRAC”) for a 3 year period.
